Terms and Conditions – Airauto Parking, Lda.
1.Definition
- COMPANY – Airauto – Car Hire Ltd, owner of the private, secure car park equipped with a CCTV system;
- Customer – A natural or legal person who will use the car park in accordance with the terms of this agreement;
- Vehicle – A light motor vehicle owned by the customer making the booking, with no items inside and without a fitted trailer;
- Faro International Airport – Located in the immediate vicinity of the headquarters of Airauto, the company that operates the car park covered by this agreement.
2. Purpose of the Contract
This contract entitles the customer to use the facilities of Airauto, Lda. in Faro or those of its partners within a 5km radius. The service is valid for the contracted period and is subject to the terms and conditions set out in this document.
3. Contract Term:
The term of this contract shall be for the period agreed between the parties, and may be extended or brought forward by mutual agreement between the Client and the Company, subject to prior notice.
1. Terms and Conditions of the Digital Contract
The customer accepts this contract in digital form, as well as all the clauses contained therein, acknowledging that it has the same legal validity as if it had been entered into in hard copy.
The customer further declares that they have received a digital copy of this contract and undertakes to retain it until the expiry of this contract
2. Car hire company details
Airauto – Aluguer de Automóveis, LDA is based at Estrada do Aeroporto, 427-A, Vale das Almas, 8005-146 Faro, Tax Registration Number 501761470.

3. Cancellation Policy
The booking must be cancelled at least 24 hours before the vehicle is due to park in order for the cancellation to be made free of charge.
4. Opening Hours
The Back Office is open from 9.00 am to 6.30 pm, Monday to Sunday, to assist you and answer any queries.
The counter located next to Faro Airport is open from 08:00 to 20:00, Monday to Sunday, for parking and vehicle collection.
5. Collection or return outside normal opening hours
All rentals where the vehicle is collected and/or returned outside the counter’s opening hours (between 8.00 pm and 8.00 am) will be subject to an out-of-hours charge, in accordance with the specific terms of the contract.
6. Condition of the vehicle’s interior
Please do not leave any belongings or valuables inside vehicles.
7. Vehicle Collection and Return
Airauto declares that the vehicle was delivered in good working order, with all the accessories and documents specified in the Contract and in the joint inspection report (“Damage Report”), and undertakes to return it in the same condition, at the agreed location, date and time.
Any extension or change to the parking period is subject to Airauto’s approval; the Customer must contact our offices to enter into a new contract.
Airauto accepts no liability for the loss, theft or damage of any items left in the vehicle, either during or after the parking period.
8. Damage Inspection
It is essential that the customer checks, together with a member of our staff, all damage recorded in the vehicle’s Damage Report before leaving the car park.
The customer’s signature on the report confirms their acceptance of the vehicle’s condition at the time of parking, and serves as a reference for any potential liability during the hire period.
9. Directions
Vehicle handover / parking
- Please park your car at the Airauto car park, located at Estrada do Aeroporto, 427-A, Vale das Almas, 8005-146 Faro.
- An Airauto representative will be on site to collect and inspect the vehicle.
- After drop-off, a shuttle service will be provided to take you to car park P4 at Faro Airport.
Vehicle recovery
- The meeting point is at car park P4 at Faro Airport.
- To get to Car Park P4, simply follow the signs for “Pre-Booking Rent-a-Car” as you leave the terminal.
- A member of the Airauto team will be there to welcome you and assist you.
- Transport will be provided by a shuttle bus from car park P4 to the Airauto counter, located approximately 300 metres away.

10. Terms and Conditions of Service
In accordance with the terms of this contract, the Customer shall be entitled to the following benefits:
- Parking and Security: The vehicle will be parked at the Airauto car park or at partner facilities within a 5km radius for the entire duration of the contract.
- Space Management: To optimise space utilisation, Airauto reserves the right to move the vehicle between its car parks and the premises of its partner organisations.
- Free Transfer: The company provides a free transfer service for guests and their companions between the park and the airport (return journey), in accordance with the agreed times and terms.
- Additional Services: Other extra services, such as car washing, may be provided subject to prior agreement between the Customer and the Company.
11. Conditions for the Granting of Benefits
To take advantage of the benefits mentioned, the following rules apply:
- Drop-off and Parking: The Customer must hand over the vehicle keys to the Company’s authorised representatives upon dropping off the vehicle at the Airauto car park. The vehicle will be parked at the Company’s premises or at partner car parks within a 5 km radius.
- Space Management: The company’s team is authorised to move the vehicle within the premises whenever necessary, whether to allow other vehicles to exit or to optimise the organisation of the car park.
- Transfer between car parks: Airauto reserves the right to transfer the vehicle between its own facilities and those of its partner organisations, in order to optimise the management of available parking capacity.
- Driving Authorisation: Company staff are authorised to drive the vehicle on the route between the Airport and the Park (or partner facilities within a 5 km radius) if a collection service has been requested, without the need for additional consent for each journey.
12. Online Booking and Reservation Procedure
To purchase the services available on the website, the user must follow the on-screen instructions and confirm the transaction by following the steps provided.
Requirements and Formalisation
- Minimum age: If the customer is a private individual, they must be at least 18 years old to make a purchase.
- Booking: The booking is confirmed by completing the forms during the purchase process and by explicitly accepting these Terms and Conditions, as well as the specific rules for the chosen service.
- Completion: The process is completed by clicking the ‘Buy and Pay’ button. This final step confirms the submission of your details and constitutes full acceptance of Airauto’s commercial offer.
13. Cancellations and Changes to Prepayments
For bookings made with advance online payment, the following refund conditions apply:
- Full Refund (100%): Cancellations notified up to 48 hours before the start of the service.
- Partial Refund (50%): Cancellations made between 48 and 24 hours in advance.
- No Refund: Cancellations made with less than 24 hours’ notice or after the service has commenced.
Please Note: Cancellations must be made in writing by emailing info@airauto.pt.
If the vehicle is collected after the agreed date, the customer must pay the additional charge (at the current daily rate) at the time of collection. If you choose to collect the vehicle before the agreed period has ended, no refund will be given for the days not used.
14. Long-term contracts and periodic payments
For contracts lasting longer than one month with monthly payments, payment will be taken by direct debit from the credit card when the monthly invoice is issued. In the event that a payment attempt is declined by the card-issuing bank, the Company reserves the right to charge the Customer for the associated administrative costs of the chargeback.
15. Fixed-Duration Parking
For stays of a fixed duration, payment must be made in advance.
- Early Collection: The Customer may collect the vehicle earlier than scheduled, but remains liable for payment of the full agreed amount, with no entitlement to a refund.
- Late Check-out: If you check out after the agreed date, you will be charged for the additional days based on the price list in force at the time of check-out, unless otherwise agreed in writing.
16. Battery Recharging Service
By requesting the recharging service, the Customer expressly authorises the Company to handle and connect auxiliary cables to the vehicle’s battery terminals.
17. Additional Terms and Conditions and Fees
- The vehicle will be handed over in accordance with the method agreed between the Customer and the Company: either directly at Airauto’s premises or via the Valet/Driver Car service (collection from the airport prior to boarding by duly identified staff). In both cases, the check-in procedures described in clause 7 must be followed.
- The vehicle will be returned to the customer upon prior request, using one of the following options:
- You can arrange your return in advance (at the time of booking), when you collect the car, by telephone or by email. You will need to provide your flight details (airline, date and time) and choose your drop-off option: directly at the terminal (Valet/Driver Car service) or via Airauto’s free shuttle service between the airport and the car park.
- Customers may also request a vehicle by contacting a company representative at the airport or by calling our customer service team directly. In such cases, the customer acknowledges that the handover of the vehicle or transport to the car park may be subject to delays or may not be possible immediately.

- The applicable price will be that set out in the current price list for the car park or the amount indicated by the simulator on the official website. Billing is processed in 24-hour periods; no partial hours will be charged. Depending on the parking option and service selected, payment must be made online or upon collection of the vehicle. Please note that payment must be made digitally (TPA); cash is not accepted.
18. Client’s Responsibilities
1 – The Customer undertakes to fulfil the following obligations towards the Company:
- Vehicle Condition and Documentation: The vehicle must be handed over in perfect mechanical condition, with all servicing and inspections up to date, and accompanied by all the legal documentation required by Portuguese law to prove ownership of the vehicle and authorise its use by the Company’s staff.
- Access and Security: Provide the vehicle keys, as well as any alarm remote controls (if separate) or other devices required to deactivate security systems, if necessary.
- Driving Authorisation: To permit Company employees to enter the vehicle and drive it for the purposes set out in the contract.
- Access Restriction: Ensure that no third party gains access to the vehicle, except where required by law or by order of the competent authorities (such as law enforcement agencies or judicial bodies).
- Control Procedures: You must complete the check-in and check-out procedures and sign the relevant documents.
- Personal Belongings: Remove from the vehicle all personal belongings or valuables that are not strictly necessary for driving or parking the vehicle.
- External Accessories: Authorise the Company to remove and store easily detachable external accessories (such as aerials); these must be replaced when the vehicle is returned.
- Payment: Please pay for the service in accordance with the price list in force on the website on the date of booking.
- Parking: Authorise the Company to manoeuvre and park the vehicle in its own car parks or those of its partners within a 5km radius of Airauto’s premises.
- Repairs in the Event of a Claim: You agree that, in the event of damage, repairs shall be carried out exclusively at the workshop designated by the Company.
- Accidents on Public Roads: Make a claim under the vehicle’s compulsory insurance if an incident occurs whilst the vehicle is being driven on a public road.
- Punctuality: Please adhere strictly to the agreed times. The Company shall not be held responsible for any delays in the delivery or collection of the vehicle resulting from the Customer’s failure to meet the agreed times.
19. CLAUSE 7: DELIVERY AND RETURN OF THE VEHICLE
- Delivery Procedure
Whether the car is dropped off directly at the Airauto car park or via the valet/driver service at the airport, the following rules apply:

- Personal Belongings: Customers must remove all items that do not belong in the vehicle (mobile phones, computers, cameras, clothing, etc.). The company accepts no liability for the loss of any items left inside the vehicle or in the boot.
- Inspection (Check-in): At the customer’s request, an inspection of the car’s general condition (interior and exterior) will be carried out, with any existing damage or faults recorded; photographs may be taken. This record will be kept by the company for up to 3 days after the car is returned.
- Handover Document: If requested, a document will be signed recording the mileage, fuel level and other relevant details to establish liability.
- Return Procedure (Check-out)
When the vehicle is returned to the customer (at the airport or at the car park):

- The customer must carry out a technical inspection to check the fuel levels, mileage and that there is no new damage.
- Please note: Any complaints must be made in person at the company’s premises in the car park. Airauto’s liability ceases as soon as the vehicle leaves the car park or is handed over as agreed at the airport terminal.
- Deadlines for Complaints
Following the return inspection, the customer has a maximum of three consecutive days to raise any complaint regarding damage or defects. Once this period has expired, the right to complain lapses.
- Vehicle Condition Acceptance
If the customer does not make an explicit complaint at the time of collecting the car, they are deemed to have accepted the vehicle in the exact condition in which it was handed over to the company. Failure to comply with these formalities or deadlines will result in subsequent complaints not being accepted.
20. THE COMPANY’S CIVIL LIABILITY
1. Scope of Liability
The Company shall be liable to the Customer for damage caused by its employees, exclusively in the following situations:
- Handling of the Vehicle: Damage occurring whilst the vehicle is being moved on the Airauto premises or at partner facilities (within a 5 km radius), in accordance with the terms of clause 4.2.
- Passenger Transport: Personal injury to the passenger or accompanying persons during the transfer (clause 4.1(c)), provided that such injury results from gross negligence or wilful misconduct (fraud) on the part of the Company’s driver.
- Other Unlawful Acts: Damages arising from serious or wilful misconduct on the part of employees or agents, for which liability cannot be legally excluded (in accordance with clause 7.2).
- Disclaimers
The Company accepts no liability for the following items or situations:
- Items Left Inside: Theft of property left inside the car after handover, in breach of the obligation to remove it (clause 7.1(a)).
- Mechanical Damage and Third-Party Damage: Mechanical faults not caused by the team, damage caused by third-party intrusion (even with security systems in place) or unavoidable natural events.
- Natural Disasters: Damage caused by adverse weather conditions or natural disasters, which is not covered by the insurance policy.
- Glass Breakage: There is no cover for isolated instances of glass breakage.
- Missed Flights: It is the Customer’s responsibility to arrive in good time (20 minutes before check-in opens). The Company accepts no liability for flights missed due to delays at check-in, heavy traffic, bad weather or congestion on the approach to the airport.
- Operational issues: Failure to start, mechanical breakdowns, problems with electric windows, flat tyres, pre-existing damage to the bodywork or flat batteries. The Company will provide assistance where possible, but no claims may be made in respect of these matters.
- Cosmetic Damage and Paintwork: Minor scratches, chips or damage to the paintwork that do not result from a structural impact (dents or deformations) are excluded. Damage to the underside of the vehicle or damage that is not visible due to dirt on the vehicle is also excluded.
3. Vehicle Movement
- In order to ensure the smoothest possible parking arrangements, Airauto reserves the right to move your vehicle to other car parks operated by itself or by partner organisations.
4. Refunds
- Refunds of parking fees are strictly limited to cases where the user misses their flight.
5. Suspension of Transport
- The company reserves the right to temporarily suspend passenger transport whenever this is deemed necessary for public health reasons or to safeguard the safety of its customers.
21. THE CUSTOMER’S DUTIES AND RESPONSIBILITIES
1. Offences and Legal Costs
The Customer is solely liable for any fines or penalties that the Company is required to pay as a result of irregularities relating to the vehicle, its documentation or ownership (within the framework of Portuguese law). In addition to reimbursing the amount of the fines, the Customer must reimburse the Company for all additional expenses, including lawyers’ and solicitors’ fees incurred in resolving the matter.
- Right of retention for non-payment
If the Customer fails to settle the cost of the service or any other associated charges, the Company reserves the right to retain the vehicle. The vehicle will only be returned once the debt has been paid in full; this amount will be adjusted to include any additional parking charges for the extra days the vehicle has been held, plus the applicable interest on arrears.
22. Personal Data
- 22.1 The Customer undertakes to provide, at the start of the Contract, their personal data for the purposes of identification, the performance of this Contract and compliance with legal obligations.
- 22.2 Airauto is the data controller responsible for processing the personal data provided under this Agreement, and undertakes to process such data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation – GDPR) and Law No. 58/2019 of 8 August.
- 22.3. The personal data collected is used for the purposes of managing the contractual relationship, invoicing, complying with legal obligations, claims handling, debt collection and, where applicable, communicating with public or private bodies in connection with this Contract.
- 22.4. Under the applicable legislation, data subjects are guaranteed the right to access, rectify, update, restrict the processing of, object to and erase their personal data; they may exercise these rights by submitting a written request to Airauto.
- 22.5. Airauto may disclose the Customer’s personal data to third parties whenever this is necessary to comply with legal or contractual obligations, including public authorities and insurers, whilst ensuring, in all cases, the confidentiality and security of the data processed.
23. FINAL PROVISIONS
Any amendments to the terms of this contract must be made in writing. The Customer must send any communications to the Company’s official contact details (postal address or email), whilst the Company will send notifications to the Customer’s address as set out in the specific terms and conditions.
24. AGREED JURISDICTION
In the event of a dispute, the Customer may refer the matter to an alternative dispute resolution body for consumer disputes, namely CIMAAL – the Algarve Centre for Information, Mediation and Arbitration of Consumer Disputes -Ninho de Empresas Building, Estrada da Penha, 8005-131 Faro – Tel. 289 823 135 (call to national landline network) – Fax. 289 812 213 – www.consumidoronline.pt – e-mail: cimaal@mail.telepac.pt
Failure to comply with any clause constitutes a breach of contract and may result in payment of up to the maximum amount of the applicable excess.
All amounts stated in this contract include VAT at the statutory rate in force.
25. LISTA DE PREÇOS
- Check Prices: You can check prices directly at the Airauto car park or using the simulator available at airauto.pt
- Parking Space: The minimum charge is for 24 hours. Partial hours are not charged, so the day of arrival and the day of departure are counted as full days.
- Airport Transfer: The shuttle service between the car park and the airport is completely free of charge.
- Valet Service (Drop-off/Pick-up at the Terminal): If you choose to have a driver drop off or collect your vehicle directly at the airport, a fee of €5.00 applies.
- Grace Period: Stays are calculated in 24-hour blocks. However, we allow a 2-hour grace period on the final day to allow for any delays.
